2018-PPW-052 Dust Abatement Program - Non-Residential COUNTY OF NEWELL - POLICY HANDBOOK POLICY NO: 2018-PPW-052 TITLE: DUST ABATEMENT PROGRAM - NON-RESIDENTIAL ADOPTED: March 8, 2018 (C-81/18) SUPERCEDES NO: 2013-PPW-052 (December 5, 2013) TO BE REVIEWED: PAGE NO: 1 of 3 POLICY PURPOSE: To outline the parameters of the County of Newell Dust Abatement Program - Non-Residential. Municipal Services identifies roads that require dust abatement to be approved annually by Council. Non-Residential Applicants may request to have dust abatement placed on roads through an application process. POLICY GUIDELINES: 1. Non-Residential Dust Abatement Program a. Locations identified by the Department and/or Council where application is of overall benefit to the community (primarily dust control, may include reducing grading frequency). i. 800 meters applied entering Hamlets and urban centers (as identified in the land use bylaw). ii. Adjacent to parks, halls, campgrounds, cemeteries, historical sites for the length of the site. iii. Gravel roads that run parallel to paved roads where dust may impede sight lines/safety of motorists on paved roads. iv. 100 meters on roads adjacent to residences, commercial and industrial buildings or sites (50 meters each way from primary driveway) on County Aggregate Haul Routes. County Aggregate Haul Routes are identified annually and approved by Council. b. Locations identified by the Department and/or Council where road surfaces require frequent maintenance (control washboard and other surface defects). Dust abatement will be applied up to 50 meters in length from any paved surface. ii. Dust abatement will be applied to reduce the need for frequent grading (ie. busy intersections with stop signs). 2. The County will place advertisements in the local newspapers each year advising Non-Residential Applicants of this program and the dates within which to make application. The advertisements will run for four (4) weeks prior to the application deadline. Advertisements on local radio will be run three (3) times daily for four (4) business days prior to the application deadline. 3. Applications from Non-Residential Applicants for dust abatement must be received by the last business day in April not later than 4:30 pm of the current year. 4. Non-Residential Applicants will pay a fee as per the Schedule of Fees Bylaw. 5. Non-Residential Applicants that have had dust abatement paid for in the past due to County Aggregate Haul Routes or otherwise approved by Council that will not be on the approved program for the upcoming year will be advised by letter of this fact so that they will be able to apply for dust abatement on their own. 6. An application must be signed by the applicant for dust abatement which will include, but not be limited to, the following provisions: a. The County will place the dust abatement. b. The County may shift applicants dust abatement areas to eliminate 50 meters or less gaps between other dust abatement areas. The road is maintained when it is deemed necessary by the County, which would allow for grading of the road to eliminate hazards, and that doing so does not obligate the County to re-apply dust abatement to the road. d. The County does not guarantee any life expectancy of the dust abatement application. 7. The cost of the dust abatement must be paid in full by the applicant at the time the application is submitted to the County. 8. This policy only applies to Non-Residential Applicants within the County that are on roads under the control and jurisdiction of the County. 9. Non-Residential Applications submitted adjacent to three (3) digit gravel (secondary) highways will be accepted, however will only be completed once the Department has received authorization from Alberta Transportation to place the dust abatement. The Department shall seek the authorization from Alberta Transportation on behalf of the applicant. 10. Non-Residential Applicants are not to spread dust abatement on County roads at their own expense using their own or contracted equipment and materials without prior approval of the Director of Municipal Services, and/or designate. 11. The County will ensure that the surface of the road is in suitable condition prior to applying dust abatement. 12. The policy guidelines may only be varied by a motion of the County Council. County Council will review requests for variances to this policy on a case-by-case basis.
